A federal court has allowed a proposed class action to go forward against CVS Pharmacy over allegations its technicians were not paid for time spent working on a mandatory online training course.

U.S. District Judge Gerald McHugh of the Eastern District of Pennsylvania on Wednesday denied the health care retail giant’s efforts to toss the case, Dean v. CVS, finding that, for at least one of the name-plaintiffs, clear questions of fact existed as to whether the company had an implied contract with its employees over compensation for the training.
