The Fourth District Court of Appeal reversed itself Wednesday, canceling a $36.7 million award to a Fort Lauderdale tobacco smoker and giving Philip Morris USA Inc. a new damages trial on the basis of jury prejudice.

The court, which upheld the jury’s determination that the company was liable, rewrote the portion of its own June 22 opinion that found the judgment for Cindy Naugle was not excessive. The jury originally awarded damages totaling $300 million.
