A Pennsylvania federal judge has certified a class of plaintiffs who allege the claims administrator for the In re BankAmerica Securities Litigation settlement fund caused the plaintiffs to receive reduced payouts by allowing fraudulent claims.
U.S. District Judge Jan DuBois of the Eastern District of Pennsylvania granted Wednesday the motion for class certification in Oetting v. Heffler, Radetich & Saitta. Plaintiff James Oetting sued claims administrator Heffler, Radetich & Saitta as well as three individual defendants who oversaw the claims process during the payout period.
