Wolf Block is arguing its decision to stop severance payments to a former partner in the wake of the firm’s vote to dissolve was the trigger for its insurance coverage, not when it actually stopped making the payments after the policy period ended.

In its response to Federal Insurance Co.’s motion to dismiss Wolf Block’s lawsuit seeking coverage, lawyers representing Wolf Block said its insurer knew about the potential for the underlying lawsuit in 2009, before the policy period ended. Attorneys for the defunct firm said it doesn’t matter that the actual underlying suit against the law firm was filed in 2010 or that it stemmed from events in 2010, after the coverage period ended.
