Parties regularly enter into contracts that include binding arbitration clauses whereby the right to seek relief in the Pennsylvania courts is waived. In the construction industry, in particular, contracts with alternative dispute resolution clauses are the norm.
Frequently, during the course of the performance of contracts, pressing circumstances arise in which parties may need to seek injunctive relief to protect the status quo, notwithstanding the contractual terms that would seem to bar equitable remedies.
