A few months ago, our office conducted a deposition in a complex divorce matter. We represented the husband, “Rob,” and we were taking the deposition of Rob’s soon-to-be-former wife, “Kelly.” (Names have been changed.) Kelly had included a claim for alimony in her divorce complaint and had previously told us that she was living platonically with another man in the house.

Kelly also took this position at the start of her deposition. When asked if she was living with another man, she said yes, but “Alex” was just a friend staying at her house. When asked if Alex was her boyfriend, she said no. When asked if she was cohabiting with Alex, she said no. Then we pulled out screenshots of her Facebook page.
