The state Superior Court has ruled that personal injury defendants should be able to see pre-accident mental health records in cases where plaintiffs claim the accident caused mental health injuries.
A three-judge panel ruled unanimously that pre-accident records were discoverable in a case in which the plaintiff claimed she suffered from anxiety as a result of a motor vehicle accident.
