The Pennsylvania Supreme Court divided evenly over the question of whether a police officer had probable cause to conduct a so-called Terry stop on a man who was running away from the sound of gunshots.

The court split 3-3, with Justice P. Kevin Brobson authoring a Sept. 28 opinion in support of affirming the lower court that Chief Justice Debra Todd and Justice Sallie Updyke Mundy joined, and Christine Donohue, Kevin Dougherty and David Wecht each writing their own opinion in support of reversal.
