A federal judge in Pennsylvania has denied a group of delivery drivers’ unopposed motion for approval of a Fair Labor Standards Act collective action settlement with Amazon, deeming the named plaintiffs’ requested service award “unreasonable” and the agreement’s release provision overbroad.

In a May 8 opinion, U.S. District Judge Mark A. Kearney of the Eastern District of Pennsylvania conditionally certified a Fair Labor Standards Act collective action for settlement purposes under 29 U.S.C. § 216(b), but ultimately concluded that he couldn’t approve the proposed settlement agreement.
