The Pennsylvania Superior Court has given a plaintiff another chance to litigate an eight-year-old lawsuit that was left to linger when his attorney was suspended mid-case.
The three-judge panel determined Wednesday that a trial court had improperly terminated plaintiff Rodshon Myers’ civil case due to inactivity, in part because felony misbehavior from Myers’ then-lawyer prevented him from fighting the dismissal.
