Jeffrey Thomas, a western Pennsylvania district attorney facing sexual assault charges, has filed a motion for Cambria County Senior Judge Timothy Creany to recuse from the case brought before the Somerset County Court of Common Pleas.

The motion stems from allegedly expletive-filled exchanges with the judge over a proposed defense witness and the judge’s alleged accusations that defense counsel had not properly served prosecutors with a particular motion. Thomas’ attorneys, Ryan Tutera and Eric Lurie, filed the motion Monday, claiming the court’s actions “did not allow the defendant a fair opportunity to be heard.”
