Since it leaked, jurisprudential experts across the country have been reading and rereading Justice Samuel Alito’s draft opinion in Dobbs v. Jackson Women’s Health Organization (WHO), which would overturn Roe v. Wade, the 1973 decision that granted the right to an abortion.

While not comparable in any other way, abortion rights are LGBTQ+ rights because Roe was decided based on the notion of substantive due process and equal protection, which allows courts to protect fundamental rights from government interference. And it just so happens that every LGBTQ rights case has been decided on principles of equal protection and substantive due process.
