Hershey sued the Cookie Department Tuesday in Pennsylvania Middle District Court over trade dress claims. The complaint, brought by McNees Wallace & Nurick; and Riley Safer Holmes & Cancila, accuses the defendant of selling cookie products with packaging depicting shapes that mimic the ‘pointing tip’ look associated with Hershey’s Chocolate Kisses. Lawyers have not yet appeared for the defendant. The case is 1:21-cv-01675, The Hershey Company et al v. The Cookie Department, Inc.
