A Lackawanna County Court of Common Pleas judge ruled that a Connecticut-based auto dealership can be sued in Pennsylvania because its website specifically targets consumers from the Keystone State and actively pursued their business.

The civil action in D&S Auto Sales v. Commercial Sales & Marketing arose from the plaintiff’s purchase of a Ford F-550 Self Loader Truck from CMS Truck Sales and the alleged faulty service and repair of the truck at Valenti’s dealership in Connecticut.

According to Judge Terrence R. Nealon, enough buyer-seller activity occurred on Valenti’s interactive website to establish general jurisdiction to move the case forward in Pennsylvania.
