Facing a constitutional challenge to its rules for naming law firms, the New Jersey Supreme Court has approved a change allowing firms to adopt trade names instead of operating under a title derived from the names of lawyers practicing at the firm.

The revision to RPC 7.5 was undertaken “to ensure compliance with constitutional principles,” acting Administrative Director of the Courts Glenn Grant said in a notice to the bar Thursday. While the requirement that a law firm name include the name of a lawyer was eliminated, the court retained the requirement that a trade name must not be “misleading, comparative, or suggestive of the ability to retain results.”
