A man whose foot was crushed by a tractor lost his bid to hold the tractor manufacturer liable for over $18 million worth of injuries he allegedly suffered. However, that plaintiff is now pointing to recent developments in Pennsylvania products liability law as part of his effort to obtain a new trial.

In late June, a Philadelphia jury awarded a defense verdict in Timmonds v. AGCO, rejecting plaintiff Michael Timmonds’ claim the tractor that had run over his foot years before had been unsafe. Last month, Timmonds filed a post-trial motion, contending that the jury instructions following trial failed to pass muster under the state Supreme Court’s Tincher v. Omega Flex decision, which recalibrated products liability law in Pennsylvania.
