The nation might be watching the Texas Court of Criminal Appeals’ dismissal of former Gov. Rick Perry’s case for political reasons, but for Texas lawyers, excitement comes from the appearance that the high court’s ruling expanded Texas pretrial habeas law.

Criminal defense lawyers say the ruling opens the door for defendants to argue that courts should decide more types of constitutional claims before a trial. But prosecutors counter that courts are unlikely to adopt such arguments, because the CCA’s ruling in Perry’s case was narrow and limited.
