In a strongly worded opinion, the U.S. Court of Appeals for the Fifth Circuit refused to dismiss excessive force and fabrication of evidence claims against a group of Sachse police officers accused of wrongfully shooting a teenage boy and framing him for felony aggravated assault charges.

The decision won by Addison attorney Jack Ayres will allow his clients—the profoundly disabled shooting victim and his parents—to proceed to trial against three police officers in a Dallas federal court. And he hopes the civil lawsuit will force a change in the officers’ department with regard to their policy of using deadly force.
