The Texas Supreme Court issued a ruling that drew applause from medical malpractice plaintiffs lawyers—a rare occurrence in the state’s post-tort-reform era.
The court reversed and remanded a lower appeals court interpretation of whether a claim falls under the Texas Medical Liability Act and therefore requires the plaintiff to file an expert report for the case to continue.
