Grocery store worker awarded $451,000 on termination claim

A Kroger employee who claimed that he was fired, rehired and then constructively discharged was awarded $451,000 on Sept. 26. Karl Tipple, who has been diagnosed with developmental disorders and learning disabilities, claimed that he was demoted and harassed when he was transferred to a new store. He was an assistant bakery manager and then was assigned as a bagger. He had worked for Kroger for five years. When he complained about the harassment, he was fired but then rehired with an assignment for a new store 13 miles away. But since he couldn’t drive, Tipple had no reasonable way of getting to work anymore.
