Two U.S. citizens of Middle Eastern origin who were removed from an airplane had their discrimination lawsuit reinstated after the U.S. Court of Appeals for the Fifth Circuit ruled on three issues of first impression.

A Fifth Circuit panel reversed a Northern District of Texas federal court dismissal of a racial and national-origin discrimination claim brought by men of Egyptian and Jordanian origin, finding “the strange fact pattern—namely, that all passengers had their flight canceled—raises several issues of first impression for this circuit.”
