A Tarrant County trial court erred when it granted Arlington a dismissal based on jurisdiction in a suit brought by homeowners that alleged the city’s intentional breach of a dam caused $2 million in damages to their properties, an appellate court ruled.
The Second District Court of Appeals rejected the city’s use of the doctrine of necessity at the jurisdiction stage of an inverse condemnation claim, concluding that the doctrine is a defense that must be proved.
