The U.S. Court of Appeals for the Fifth Circuit reversed the district court’s decision to grant summary judgment to Allstate Assurance Co., based on a genuine dispute over a material fact. Both sides disputed whether Guzman was a smoker at the time he filled out the life insurance application.
