Salesman Dennis Demnicki was knocked unconscious when he slipped on a puddle in the reception area of a manufacturing company’s King of Prussia location. But steps allegedly taken after Demnicki fell—in which the company’s safety manager allegedly hid evidence of the incident—also helped secure a $6 million settlement, according to plaintiff’s counsel in the case.

According to court records, Demnicki and First Quality Enterprises recently agreed to settle the case Demnicki v. First Quality Enterprises, with primary carrier Liberty Mutual agreeing to pay $1 million and excess insurer XL Catlin agreeing to pay $5 million. Along with the post-incident conduct, the plaintiffs had contended that the floor was dangerous when wet and the safety manager never properly assessed the facility.
