The Pennsylvania Supreme Court will not review a divided en banc Commonwealth Court’s ruling that state courts have jurisdiction over disputes arising under the Alternative Energy Portfolio Standards Act.

The Commonwealth Court ruled 5-2 last fall to affirm a trial judge’s decision not to cede jurisdiction to the state Public Utility Commission in Sunrise Energy v. FirstEnergy, finding that the legislature did not authorize the PUC or any other state agency to hear matters that require interpretation of the act.
