An inmate who won $200,000 personal injury verdict against a prison guard for physical and sexual assault has lost a bid to garnish the guard’s wages to pay up, but judges on the U.S. Court of Appeals for the Eleventh Circuit have offered an option for trying again.
Judges Gerald Tjoflat, William Pryor and R. Lanier Anderson denied David Cassady’s motion for garnishment against state corrections officer Steven Hall in a per curiam opinion Friday. The panel upheld Judge Marc Treadwell of the U.S. District Court for the Middle District of Georgia in denying the request. But the decision only applies to federal court.
