Ocean State Job Lot was slapped with its second federal lawsuit in nine days claiming the retail chain is selling “gray market” Duracell batteries in the United States originally meant for sale in Asia.

A prospective class action, which the suit said could include thousands of customers and be in excess of $5 million, was filed Friday in U.S. District Court for the District of Connecticut. New York resident Kevin Stewart claims he was misled when he purchased three sets of Duracell batteries at an Ocean State Job Lot in Fishkill, New York.
