Nebraska and Oklahoma, undeterred by rejection in the U.S. Supreme Court, are pinning their push to topple Colorado's marijuana law on their intervention in lawsuits in a federal appellate court. The high court in March declined to take up a suit by the two states, which claim Colorado's voter-approved law legalizing the recreational use of marijuana violates federal drug laws. Nebraska and Oklahoma, citing “significant” harm from the flow of marijuana across state borders, have moved to intervene in cases in the U.S. Court of Appeals for the Tenth Circuit.
