New Jersey Foreclosure Law and Practice is an essential resource for those representing banks, mortgage companies, municipalities, condominium and homeowner associations, investors, and more.

Since New Jersey Foreclosure Law & Practice was originally published in 2001, New Jersey has experienced record numbers of foreclosures. The large volume of foreclosures has, in turn, led to significant revisions of the Court Rules applicable to foreclosures, as well as legislative reform. In addition, the courts have rendered numerous decisions refining and, in some cases, changing existing law.

This edition incorporates all of the recent developments in this important area of law, including new authority with respect to the notice of intention to accelerate and foreclose, germane and non-germane counterclaims, fraudulent inducement as a defense, objections to the notice of sale, stays of foreclosure sales, applicability of the deficiency statute, claims to surplus monies, and the effect of bankruptcy on pending cases.

Chapters include:

  • The Fair Foreclosure Act
  • The Fair Debt Collection Practices Act
  • Default and Acceleration
  • Parties in a Foreclosure Action
  • The Foreclosure Complaint
  • The Notice of Pendency
  • Receiverships in Foreclosure
  • Responses to the Foreclosure Complaint
  • Typical Borrower Defenses
  • Disposition of the Foreclosure Action
  • Judgment of Foreclosure and Sale
  • The Foreclosure Sale
  • Redemption
  • Deficiency Actions
  • Surplus Money Proceedings
  • Strict Foreclosure; Reforeclosure
