
Attorneys on either side of contested negligence claims faced off during oral arguments at the Georgia Supreme Court. At the center of their dispute is whether a Metropolitan Atlanta Rapid Transit Authority (MARTA) train conductor breached the duty of care imposed under Georgia law surrounding "carriers of passengers." Appellant counsel contend the answer should only be derived from a jury, but appellee counsel counter the inquiry should be occluded by summary judgment.
