Confusion in the federal courts over what constitutes a "final" ruling got an answer from the Texas Supreme Court that resuscitates two personal injury claims against The Boeing Co. American baseball legend Yogi Berra, famous for his quirky quotes, once put the world on notice that "It ain't over 'til it's over." The U.S. Court of Appeals for the Fifth Circuit recently had its own experience the finality conundrum and in it's own way responded, "Wait, what?" and punted the question of when a case is over to the state's high court justices. At issue was the extent of a time period set by statute after the trial court ruled it did not have jurisdiction and whether the court's subsequent dismissal barred the plaintiffs from proceeding in another court.
