
A class of defendants represented by virtually every major commercial litigation law firm in Texas were granted a reversal against claims brought by consumers affected by Winter Storm Uri. The First Court of Appeals in Houston ruled the pretrial multidistrict litigation court erred when it denied the motion to dismiss brought in five bellwether cases that will affect approximately 350 wholesale power generation companies. Joseph A. "Tre" Fischer III of Jackson Walker, a defendants' steering committee member and liaison counsel, said 120 law firms represent the power generator class of defendants. The February 2021 event known as Winter Storm Uri led to a catastrophic loss of electric power across the State of Texas. Peak outages affect 4.5 million Texans, caused hundreds of deaths and billions on property damage.
