Excellus Health Plan Inc. sued Blackfly Investments d/b/a Molecular Testing Labs on April 30 in New York Western District Court. The suit, backed by Bond, Schoeneck & King, seeks to recover more than $300,000 in payments made by Excellus for COVID testing of certain nursing home employees in 2020 and 2021. The suit contends that the testing, which was mandated for surveillance purposes and not performed to diagnose individuals, was not covered by Excellus and the payments were made in error. Counsel have not yet appeared for the defendant. The case is 6:24-cv-06263, Excellus Health Plan, Inc. d/b/a Excellus Bluecross Blueshield v. Blackfly Investments, LLC d/b/a Molecular Testing Labs.
