New Suit - ERISA Class Action

Johnson & Johnson and other defendants were named in an ERISA class action on Feb. 5 in New Jersey District Court. The suit, filed by Wheeler, Diulio & Barnabei and Fairmark Partners, accuses the defendants of breaching their fiduciary duties by failing to prudently manage Johnson and Johnson’s prescription-drug benefits program, resulting in employees paying millions of dollars in higher premiums, higher deductibles and copays. Counsel have not yet appeared for the defendants. The case is 1:24-cv-00671, Lewandowski v. Johnson and Johnson.
