WPX Energy sued four members of the Three Affiliated Tribes on the Fort Berthold Reservation and Judge B.J. Jones on Feb. 2 in North Dakota District Court. The suit, brought by Stinson LLP, pertains to a smoking restriction on a right-of-way for oil and gas drilling on the reservation which has resulted in litigation between the parties. The complaint seeks to resolve a legal dispute over whether tribal courts have jurisdiction over right-of-ways on allotted land held in trust by the U.S. government.
