Day Pitney and Quinn Emanuel Urquhart & Sullivan filed a lawsuit on Nov. 6 in Connecticut District Court challenging the forced closure of a pharmaceutical manufacturing facility by the U.S. federal government. The suit was filed on behalf of SCA Pharmaceuticals, which argues that an FDA order to shutter its Windsor facility and recall product worth tens of millions of dollars is a 'death sentence' for the company in regards to its profits and reputation. The suit centers on an Oct. 20 government report claiming certain technical issues with the facility could lead to production defects. The case is 3:23-cv-01462, Sca Pharmaceuticals, LLC v. U.S. Food and Drug Administration.
