Liberty Mutual Insurance was slapped with an insurance coverage lawsuit on Aug. 15 in Texas Southern District Court. The court action was brought by Mouer Huston PLLC and Lowenstein Sandler LLP on behalf of the Howard Hughes Corp. and the Woodlands Land Development Co. The complaint seeks a declaration that Liberty Mutual breached its duty to defend and indemnify the plaintiffs in an underlying action arising from property damage sustained by homeowners following flooding from Hurricane Harvey and seeks reimbursement for attorneys' fees. The underlying action contends that the plaintiffs failed to follow development criteria for slab elevations for new homes, resulting in the flooding of hundreds of residential properties.
