A man was hit by a car while riding his low-speed electric scooter. His auto insurer denied the claim because the scooter wasn't an auto under New Jersey law. The man subsequently sought coverage as a pedestrian, claiming New Jersey law recognized bicyclists as "pedestrians" for purposes of no-fault coverage, and therefore the definition of "pedestrian" should be extended to include low-speed electric scooter riders.
