Clark Hill filed a breach-of-contract lawsuit on Monday in Nevada District Court on behalf of OnPointe Community Care and other plaintiffs. The lawsuit stems from OnPointe's sale of St. Luke's Home Hospice to defendant Charter Health Holdings, which received a suspension from the Center for Medicare & Medicaid Services (CMS) due to alleged Medicare fraud. OnPointe alleges that Charter Health is using the suspension as an excuse to avoid making contractual earn-out payments to OnPointe. The complaint further accuses Charter Health of seeking indemnification from OnPointe in relation to the suspension. Counsel have not yet appeared for the defendant.
