New Suit - Consumer Class Action

Home Depot was hit with a breach-of-contract class action Wednesday in Georgia Northern District Court in connection with the company's tool rental equipment contract. The suit was filed by Pratt Clay LLC and The Lockett Law Firm on behalf of individuals who elected and paid for 'damage protection' under the contract. According to the suit, the contract requires Home Depot to cover costs and repairs for any damages, excluding those caused by 'theft, abuse, or intentional acts.' However, Home Depot's damage protection allegedly excludes all 'damage' and only covers 'normal wear and tear.' Counsel have not yet appeared for the defendant. The case is 1:22-cv-02605, Mathews v. Home Depot USA, Inc.
