Looking to the federal circuit courts, the Massachusetts Supreme Judicial Court sought to set a standard this week when considering a motion for a new trial for a defendant convicted of murder after his attorney allegedly slept during critical portions of the trial. While some circuits considered the portion of trial taken up by slumber, others considered important aspects of trial.
