
The judge in Johnson & Johnson's talc bankruptcies filed a Jan. 10 letter to amend a federal rule barring bankruptcy judges from appointing a special master, or court-appointed neutral. U.S. Bankruptcy Chief Judge Michael Kaplan, in the District of New Jersey, said a special master would have helped 'herd the parties' in the talc cases, part of a growing trend of mass tort bankruptcies. The American Bar Association and the Academy of Court-Appointed Neutrals support the rule change.
