Kevin M. McDonough of Latham & Watkins has entered an appearance for Virgin Galactic Holdings and other defendants in a pending shareholder derivative lawsuit. The action, filed July 10 in New York Eastern District Court by Bronstein, Gewirtz & Grossman, accuses the defendants of continuing with numerous commercial spaceflight tests without addressing known safety concerns. The suit contends that the defendants made misleading statements regarding the horizontal stabilizers of a Feb. 2019 test flight that experienced such significant damage due to human error that they took fourteen months to replace. The case, assigned to U.S. District Judge Ramon E. Reyes Jr., is 1:24-cv-04795, Gera v. Branson et al.
