
Georgia faced steep hurdles in the U.S. Supreme Court on Tuesday over its bid to retry a murder defendant after a state court vacated an earlier acquittal as invalid. The Wiley Rein attorney for accused murderer Damien McElrath told the justices that Georgia's attempt to retry his client runs afoul of the double jeopardy clause of the Fifth Amendment. "If a jury in a court with jurisdiction returns a verdict of acquittal, that verdict is final," said Wiley partner Richard A. Simpson.
