
After holding a rare en banc hearing, the U.S. Court of Appeals for the Second Circuit sent a case challenging a transgender-inclusive athletic policy at a high school back to the U.S. District Court for further proceedings. The Second Circuit did not make any decisions based on the merits of the Title IX claims or entitlement to remedy, but made a procedural and narrow decision to vacate and remand the case for further proceedings in the U.S. District Court, the opinion said.
