Rehab center Evolve Growth Initiatives filed a petition in Delaware Court of Chancery on Friday to confirm a $36 million arbitration award. The action targets Equilibrium Health Solutions, M&A Healthcare and Ducat HC over their sale of the Evolve business for $83 million. In the underlying arbitration, the panel ruled that the sellers provided false information inflating the value of the company. The petition was filed by Morris Nichols Arsht & Tunnell and Foley Hoag. Counsel have not yet appeared for the respondents. The case is 2022-1113, Evolve Growth Initiatives LLC et al. v. Equilibrium Health Solutions LLC et al.
