
The U.S. Court of Appeals for the Third Circuit has shut down efforts by New Jersey towns to collect cable television franchise fees from video streaming services Netflix and Hulu. However, the Cable Television Act does not provide an express right of action for municipalities to enforce its provisions, and there is no implied right of action, Judge Jane Roth wrote in a decision joined by Judges Patty Shwartz and D.
