Though most of the legal industry has been talking about generative artificial intelligence for months, it’s not always clear whether everybody is actually talking about the same thing. Some urge that the biggest challenge with handling disclosures of AI use will be crafting definitions that accurately encapsulate the types of tools in mind. Amid the exponential evolution of AI, this can be especially tricky for non-technologists. Some judges have required the disclosure of generative AI use in court filings, while others have either banned it outright or required disclosure of its use in any capacity. In addition, lawyers have been increasingly in favor of requiring opposing parties to disclose the use of AI tools for document review, translation or production. As well, a vast majority of clients believe they are entitled to disclosure of their attorneys’ use of the tech.
