Courts across the United States continue to uphold an employer's right to maintain a drug-free workplace. However, where recreational cannabis use has been legalized, an employer's drug-free workplace policy needs to provide clear guidelines specifically concerning an employee's use of cannabis in order to mitigate the employers' liability for discrimination as a result of recreational marijuana users now being a protected class.
