A New Jersey appeals court opinion issued Wednesday shows the perils of blurring the roles of arbitrator and mediator in a matrimonial case.
A mediator who obtains confidences from the parties or offers opinions cannot then be an objective arbitrator, the court said in Minkowitz v. Israeli.
